1. Agreement to Terms
By accessing or using Build To Income ("Service"), operated by Build To Income ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service. These terms constitute a legally binding agreement between you and Build To Income.
2. Services Offered
Build To Income provides AI-powered business creation services in two tiers:
- Discover + Validate (Free): AI-orchestrated business concept analysis delivered digitally at no cost. The deliverable is a comprehensive strategy document covering market viability, competitive landscape, revenue potential, and actionable next steps.
- Deployed Business ($399/month): Complete AI-powered business built, deployed, hosted, and managed on the buyer's domain. Monthly subscription includes hosting, maintenance, and technical support. Cancel anytime with 30 days notice.
3. Hosting, Maintenance, and Infrastructure
For Full Build projects, Build To Income provides enterprise-grade hosting and infrastructure management as part of the service:
- Your business is deployed on production infrastructure with SSL encryption, CDN distribution, and automated backups
- Monthly hosting fees cover server costs, security updates, dependency maintenance, uptime monitoring, and technical support
- We maintain the technical infrastructure so your business stays secure, performant, and operational
- The $399/month subscription covers build, hosting, maintenance, AI operations, and ongoing improvements
- If your subscription is cancelled, your business enters a suspended state after the current billing period. A migration package is available for $2,500
- We guarantee 99.5% uptime for hosted businesses, excluding scheduled maintenance and force majeure events
4. AI-Generated Content
Our services use artificial intelligence to generate business concepts, analysis, and software. By using our services, you acknowledge and agree:
- AI-generated content is provided for informational and operational purposes and does not constitute professional business, legal, financial, or investment advice
- While we strive for accuracy, AI outputs may contain errors, inaccuracies, or incomplete information. You are responsible for reviewing and validating all deliverables before acting on them
- Market analysis, revenue projections, and competitive assessments are based on available data at the time of generation and are not guarantees of future performance
- We do not guarantee any specific business outcomes, revenue, or profitability from businesses built or concepts delivered
- Your input data is processed by third-party AI providers (Anthropic, Google, Perplexity AI) subject to their respective terms of service
- We do not use your project data to train AI models or share it with other customers
5. Payment Terms
Discover + Validate (Free):
- No payment is required. The concept is generated and delivered at no cost.
- The deliverable is a digital product generated on demand using AI orchestration.
Deployed Business ($399/month):
- First payment of $399 is required before deployment begins
- Payment is processed via Square on a monthly recurring basis
- Subscription includes hosting, maintenance, AI operations, and technical support
- Cancel anytime with 30 days written notice
6. Refund Policy
Discover + Validate (Free):
- The concept is provided at no cost. No refund is applicable as no payment is collected.
- If you are unsatisfied with the quality of the concept, we offer one (1) complimentary revision round within 14 days of delivery
Deployed Business ($399/month):
- Monthly subscription fees are non-refundable for the current billing period once charged
- You may cancel your subscription at any time with 30 days written notice. No further charges will be applied after the cancellation period
- If we fail to maintain the agreed-upon service level (99.5% uptime), you are entitled to a pro-rated credit for the affected period
- Upon cancellation, your business remains accessible until the end of the current billing period, then enters a suspended state
- You may request a full migration package (source code, database export, workflow configurations, hosting documentation, and one hour of handoff support) for a one-time fee of $2,500. Migration packages are delivered within 5 business days of payment
- You may reactivate a suspended business at any time by resubscribing
Chargeback and Dispute Policy:
- Filing a chargeback or payment dispute after receiving deliverables constitutes a material breach of these terms
- Upon initiation of a chargeback, all licenses granted to you are immediately and automatically revoked
- You agree that continued use of any deliverable after a chargeback is unauthorized and constitutes infringement of our intellectual property
- We reserve the right to suspend or terminate hosted services, deactivate deployed businesses, and pursue recovery of costs, including reasonable legal fees, associated with fraudulent or bad-faith chargebacks
- We maintain delivery records, including timestamps, email confirmations, and access logs, as evidence of service fulfillment
7. Intellectual Property and Ownership
What you own:
- Upon full payment, you receive a perpetual, non-exclusive license to use, modify, and commercialize the deliverables created for you
- For Full Build projects, you own the business operations, customer relationships, revenue, and brand identity
- Your business data, customer data, and operational data belong to you
What we retain:
- Build To Income retains ownership of underlying frameworks, templates, system architectures, and reusable components used across multiple client projects
- We retain the right to use general knowledge, techniques, and methodologies gained during your project for other clients (without disclosing your confidential information)
- Our brand, website, marketing materials, and proprietary tools remain our intellectual property
No revenue share. No equity stake. No ongoing royalties. You keep 100% of the revenue your business generates. While your subscription is active, we host and manage the infrastructure. If you leave, you can take everything with you via the migration package.
8. Acceptable Use
You agree not to use our services to:
- Create businesses that violate any applicable law or regulation
- Generate content that is fraudulent, deceptive, defamatory, or harmful
- Infringe on the intellectual property rights of others
- Resell, redistribute, or sublicense our deliverables as templates, frameworks, or tools for creating businesses for third parties (you may operate the business; you may not sell the system itself)
- Attempt to reverse-engineer our proprietary AI orchestration processes
- Use our services for any illegal purpose or in violation of any applicable laws
9. Confidentiality
We treat all project submissions, business concepts, and deliverables as confidential. We will not share your project details, business ideas, or proprietary information with other customers or third parties (except service providers as described in our Privacy Policy). You agree to keep our pricing methodologies, scoring frameworks, and internal processes confidential.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Build To Income shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
- Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for business losses, lost revenue, lost profits, or lost opportunities resulting from use of our deliverables
- We are not liable for any actions taken by you or your customers based on AI-generated content
- We are not liable for third-party service outages (hosting providers, payment processors, AI providers) that may temporarily affect your deployed business
11. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your intended use. No advice or information obtained from Build To Income shall create any warranty not expressly stated in these terms.
12. Indemnification
You agree to indemnify, defend, and hold harmless Build To Income and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of our services or deliverables; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) any business operations you conduct using our deliverables.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these terms shall be resolved as follows:
- Informal resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at support@buildtoincome.com. We will attempt to resolve the dispute within 30 days
- Binding arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
- Class action waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration
For users in the European Union, United Kingdom, Canada, or Australia: nothing in these terms limits your statutory rights or restricts your ability to bring claims in your local courts where required by applicable law.
14. Termination
We may terminate or suspend your access to our services at any time for violation of these terms, with or without notice. Upon termination: your license to use deliverables survives if payment has been completed in full; hosted services will be wound down with 30 days notice; your business enters a suspended state and can be reactivated by resubscribing; a full migration package (source code, database, configurations, documentation) is available for $2,500. You may terminate your relationship with us at any time by cancelling your subscription.
15. Modifications
We reserve the right to modify these terms at any time. Material changes will be communicated via email or prominent notice on our website at least 30 days before taking effect. Your continued use of our services after changes take effect constitutes acceptance of the modified terms. If you disagree with any changes, you may discontinue use of our services.
16. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
